By placing an order, you acknowledge and agree that:

  • Delivery times are estimates and not guarantees.

  • We do not ship to freight forwarders, reshippers, or similar intermediary services where prohibited by our Shipping Policy.

  • Once a package is marked as delivered by the carrier, responsibility for the package generally transfers to the customer, as explained in our Shipping Policy and Return and Refund Policy.

  • You must report delivery issues within the timeframes specified in our policies.

  • You are responsible for complying with any destination-specific laws or import rules applicable to your order.

  • We are not responsible for customs duties, import taxes, inspection fees, permit costs, or related charges for international or regulated shipments unless expressly stated otherwise.

12. Seeds, Product Use, and Regulatory Compliance

Seeds and related plant materials may be subject to local, state, federal, tribal, provincial, national, customs, agricultural, quarantine, import, export, or phytosanitary laws and regulations depending on destination.

By ordering from us, you represent that:

  • The shipping address you provide is the final destination of the order.

  • You are legally permitted to receive the products ordered at that destination.

  • You are responsible for understanding and complying with all laws, regulations, restrictions, permit requirements, and import requirements applicable to your order.

We reserve the right to refuse, hold, limit, cancel, intercept, or decline to fulfill any order that appears to violate law, require documentation or compliance steps we do not provide, or otherwise create legal or regulatory risk.

13. Germination Guarantee and Limited Warranty

We warrant that, when properly stored, handled, planted, and cared for, our seeds will:

  • Germinate at reasonable rates for one (1) year from the date of purchase, and

  • Grow true to type for the variety purchased

This is a limited warranty and is subject to the limitations, conditions, exclusions, and procedures described in our Return and Refund Policy.

This limited warranty does not apply to issues caused by factors outside our control, including but not limited to:

  • Weather

  • Soil conditions

  • Watering practices

  • Pests

  • Disease

  • Improper planting methods

  • Improper storage

  • Improper handling after delivery

  • Local growing conditions

  • Customer error or misuse

Except as expressly stated in our written policies, we disclaim all other warranties, express or implied, to the fullest extent permitted by law, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Communications and Customer Service

By providing your email address or other contact information, you consent to receive communications from us relating to your account, orders, customer service issues, policy changes, and use of our Services.

We reserve the right to determine the manner, scope, frequency, and continuation of customer service communications.

Where we determine that a customer’s conduct is abusive, threatening, fraudulent, harassing, or otherwise improper, we may restrict communications to email only, cease non-required communications, or decline further customer service interactions except as required by law.

We reserve the right to refuse service, cancel orders, limit fulfillment, suspend or terminate accounts, restrict access to the Services, block users, or cease further communication with any user at any time, with or without notice, if we believe that:
